Terms and Conditions
The following terms and conditions apply to all purchases of goods when ordering via this website. By placing an order you are agreeing to be bound by these terms. We may revise these terms and conditions at any time without notice. You should check these terms and conditions periodically. Entering the website will constitute your acceptance of these terms and conditions, including recent changes, whether or not you chose to review these changes. Definitions and Interpretations
Acceptance of order We take reasonable care in ensuring that all material on our website is accurate and up to date at the time it is created. None of the information on our website is to be relied upon as a statement or representation of fact. All images, illustrations and descriptions are for information only and all orders are subject to availability. The contract in respect of the products supplied by us to you comes into existence only when your order has been accepted by us. For the avoidance of doubt, receipt of an order via our site does not constitute acceptance of an order. Acceptance of an order is made by notifying you in writing that your order status is "Order Complete". Until acceptance of an order is made by us, either you or us can cancel the order without reason or penalty. This means that if goods are shown on our website but are not available or are incorrectly priced or otherwise incorrectly described we shall not be obliged to sell you such goods unless we accept your order. Order Statuses Each time the status of your order changes we will inform you of the update in writing. The status options are as follows.
Prices All product prices shown are inclusive of VAT at the current rate. If an error is found in the price of a product you have ordered we will inform you in writing as soon as possible and offer you the option of reconfirming your order at the correct price or cancelling your order. Payment Your card will not be debited at the time your order is placed. You will only be charged if and when we accept your order. All credit and debit card payments are taken securely by Sagepay and are security checked to prevent any fraudulent transactions. For more information, please visit www.sagepay.com. Delivery The shopping basket will automatically work out the correct delivery charges for your order based on the combined weight of the items you have added to the basket and your delivery address. Any available options for delivery will then appear in the delivery drop down menu starting from £2.95. The number of days quoted for delivery times are estimated working days and do not begin until we have accepted your order. We aim to dispatch all orders that are in stock within 3 business days. If your item is out of stock, we will email you if it will take longer than 7 days for new stock to come in and give you the option of cancelling your order. If no one is at home when delivery is attempted the driver may check to see if a neighbour is at home and leave the parcel with them. If you leave a signed note explaining that the order can be left in a specific location, the driver can take this away and the goods can be left where you choose, however this is done at your own risk. If this is not possible they will leave a calling card and either attempt re-delivery the following working day or ask you to collect from your local depot. Clear details of this will be on the card that will be left by your driver. If the delivery address you've provided us with is incorrect or it refuses delivery of the goods or if you do not respond to the card left by the driver, your order will be returned to us and we will be charged for the return service by our courier which we must pass on to you. We will then cancel your order and refund your payment method deducting your original delivery costs plus £10 to cover the return costs. We cannot be held responsible for delays due to circumstances beyong our control such as strike action or weather conditions. We highly recommend using the courier delivery option to minimise any chances of a delay with your order. If you choose Royal Mail as your delivery option please wait at least 15 working days (for deliveries in the UK) and 28 days (for international deliveries) from the date we accepted your order before contacting us if you haven't received your order. If you provide us with a wrong delivery address and your goods are signed for by another party, we cannot be held responsible for any loss you incur as a result. Cancellations & Returns (Excluding custom orders such as photographic prints) You have the right to cancel your order with us at any time before the expiry of 7 days from the day after the date of delivery. If you inform us you want to cancel your order before the status has been updated to "order complete" we will cancel your order and you will not be charged. If your order status has changed to "order complete" you will need to return the order to us within 7 days of receiving it at your expense. Any returned goods must be unopened in their original sealed packages in which they were delivered to you and in resalable condition. To cancel your order, write "Cancel Order" on the back of the delivery note. Package the items securely and send them to us with the delivery note within 7 working days of the date that the items were delivered. We request that you email us at info@allbabyneeds.co.uk to tell us that you are returning goods before you send them. The return address is: All Baby Needs Returns 7 Williams Road Shoreham West Sussex BN43 6BPNote: For your protection, we recommend that you use a recorded delivery service or obtain a certificate of posting when returning your order. (available from the post office at time of posting). You are responsible for the costs of returning any goods to us unless we delivered the product(s) to you in error. Refunds When we receive the goods with the notice of your cancellation of this order, we will refund only the costs of the products returned in resalable condition as soon as possible and in any event within 30 days. Direct Dispatch Delivery of Large Items such as nursery furniture and pushchairs may take several weeks and be sent directly from our suppliers and the following conditions will then apply. a) Any time or date for delivery stated by us or our suppliers shall be treated as an estimate only. While every effort will be made to despatch goods within the timescale quoted, no liability can be accepted by the us or our suppliers for failure to deliver within the quoted times or within any specific time period. We shall not be liable for any loss or damage whatsoever (including consequential loss or loss of profit) arising directly or indirectly from any delay in the delivery of all or any of the goods howsoever caused. b) We will accept no liability for shortages or damage to goods unless you note the damage at the time of delivery (or where this is not possible, for orders totaling less than £250 only, notes "Unable to inspect on delivery" on the delivery note or terminal) and notify us via email within 24 hours of receipt of the goods. c) You shall be bound to accept the goods when they are tendered for delivery by our suppliers and delivery shall be deemed to take place when the goods are tendered for delivery to you at the nominated address for delivery whereupon the risks of loss, breakage or any other damage whatsoever shall pass to you. d) If for any reason you cannot accept delivery of the goods for more than 7 days after the product is available for delivery our suppliers may either elect to store the goods pending their actual delivery and you shall be liable to our suppliers for the costs (including insurance) of so doing but our suppliers shall be under no obligation to insure the goods in storage and the risk of any loss or damage to the goods howsoever arising shall be borne by you, or if the period of storage exceeds 60 days may elect to sell the goods at the best price readily obtainable and (after deducting all reasonable storage and selling expenses) account to you for the excess over the price under the contract or charge you for any shortfall below the price under the contract. e) Where access to the delivery address is limited or additional equipment is required to complete delivery of the goods, additional charges to cover the full costs of these services plus administrative costs will apply. f) The standard delivery service is a one-man curbside service. It excludes any special services or additional manpower required to effect delivery as well as evening and weekend deliveries, for which additional charges will apply. The default delivery services apply to UK mainland addresses only. It excludes islands and remote locations. Responsibility for the goods passes to you after they are unloaded from the delivery vehicle notwithstanding any assistance provided in delivering goods into your property. g) A re-delivery charge of the original shipping cost per instance will be made if a further delivery is necessary because you are not at home to receive the order, or if goods must be redelivered because they cannot fit into the premises without additional work or equipment, or if goods must be redelivered for any other reason. h) Once your order has been passed to our suppliers and the delivery process has started. Any cancellations will incur a 20% handling charge. Damaged Goods You should inspect the goods when you receive them for any damage. If the package you receive looks like it may be damaged or has been tampered with you should refuse the package or mark the courier’s sheet to show this (if you do sign to accept the package). If the goods are found to be damaged prior to delivery to you then we will replace or refund the price paid. If you find any damages you must inform us by email within 24hrs (preferably immediately on the same day you receive them). We cannot be held responsible for damages reported after 24hrs of receipt. Ownership of the goods and the risk for damage to the goods pass to you upon delivery. Product Guarantee Most items purchased from us are covered by a manufacturers guarantee however if any product arrives to you in a faulty state or develops a fault within 7 days of delivery you can return it to us for a replacement or refund. If 7 days have passed please read the warranty information that came with your product and follow the instructions to make a claim under warranty. This may involve contacting the manufacturer directly or sending the item back to us for testing. If you need to send the product back to us, the return costs will be at your expense. Please make sure to include a note with your order number and as much detail on the fault as possible. If we can confirm the fault we will either repair or replace the product. If we are unable to repair or replace the product we will refund the product price originally paid. If we cannot find a fault you will be liable for the postage and packaging charges to return the product to you. Accidental damage and damaged caused by misuse or poor assembly is not covered by the product guarantee. Product Price Match Promise We reserve the right to change our price matching policy at any time. This price match promise covers the price of the product only. Any applicable postage, packaging and handling charges are non refundable. Our price promise does not apply to auction websites, non-retail (wholesale) websites, private sales, special orders, typographical errors, clearance sales, liquidation sales, mail-in rebate offers, or where a service commitment is included in the transaction. We must be able to verify that the competitor's product is in stock, is the exact same product as the one on this page and is in a brand new, unused and undamaged condition Ordering From or Delivering to Outside of the UK. All electrical goods come supplied with a UK plug and UK warranty. You should check the voltage and frequencies of your destination country to ensure they are compatable. If not, you may be able to purchase a converter separately. If returning a faulty product under warranty the return costs to the UK will be at your expense. Free gifts and promotional items Free gifts and any promotional items are offered subject to availability and form no part of the contact between you and us. Pre-order and out of stock items If you order goods that have a status of pre-order or out of stock then you should check the website regularly for updates. If you order multiple items, your order will not be dispatched until all the items you have ordered are in stock. Delays We shall not be liable to you if we are for any reason prevented or delayed in the performance of any of our obligations to you if this is due to any cause beyond our reasonable control including without limitation; an act of God, explosion, extreme weather conditions, flood, fire or accident, war or civil disturbance, strike, industrial action, stoppages of work, terrorism, a third party act or omission, failure of our supplier(s) in diffuiculty in obtaining materials and/or labour/deliveries, failure by you to give us a correct delivery address. We will inform you of any such unforeseen event as soon as practically possible and give you the opportunity to cancel your order. Specifications, Colours, Weights and Sizes We reserve the right to alter specifications without prior notice. All sizes and weights given as a guide only and are approximate. Representations of colour are approximate due to the limitations and calibrations of the user's output device. A name given to a product is not necessarily representative of the colour. Accessories supplied to co-ordinate with the main product may differ in shade; this is normally caused by the manufacturing process and is not a fault. Wood is a natural product and the grain and finish will vary from piece to piece, manufacturers normally use different grades of wood for items such as cots or cot beds and therefore the finish can appear differently. Product Reviews You may review any product at any time even if you haven't bought it from us. However, in the interest of fairness, any reviews with a rating of less than 3 will not be published until at least a total of 3 reviews have been submitted. What is WEEE? The Waste Electrical or Electronic Equipment (WEEE) Directive requires countries to maximise separate collection and environmentally friendly processing of these items. In the UK, distributors (including retailers) must provide a system which allows all customers buying new electrical equipment the opportunity to recycle their old items free of charge. Those establishing their own take-back scheme must as a minimum offer all customers buying new electrical equipment free take back of their old electricals on a like-for-like basis. Find more information on WEEE recycling, and locate your local recycling centre, at www.recyclenow.com. Under this directive All Baby Needs Ltd. is obliged to offer our customers free take-back of their WEEE on a like-for-like basis when they buy a new Electrical or Electronic product from us. For example, if you purchase a new baby monitor from this website, you can send your old one back to us for recycling. Unwanted electrical equipment is the UKs fastest growing type of waste. Many electrical items can be repaired or recycled, saving natural resources and the environment. If you do not recycle, electrical equipment will end up in landfill where hazardous substances will leak out and cause soil and water contamination – harming wildlife and also human health.
To remind you that old electrical equipment can be recycled, it is now marked with a crossed-out wheeled bin symbol. Please do not throw any electrical equipment (including those marked with the crossed out wheeled bin symbol) in your bin. Availability All goods are subject to availability. If sold out, you will be informed and given the opportunity to choose a similar product or cancel your order.
